Putzmeister America, Inc. (“Putzmeister” or “us”) is committed to protecting the intellectual property rights of others.  We have registered under the Digital Millennium Copyright Act (“DMCA”) so we can assess and respond to copyright infringement claims if a copyright owner notifies us that they believe content posted to our website (“Site”) violates their copyright. When you post on our Site, the content you post may be subject to U.S. copyright protection.  A copyright provides legal protection to persons who make original creative works such as writings, photographs, graphics, or software. 

 

The Process We Follow:

If we receive a valid notification of alleged copyright infringement, we will remove the relevant content and take reasonable steps to contact the person or entity who pasted the removed content so that they can respond with a counter-notification.

 

If we receive a valid counter-notification, we will repost the content unless we receive notice from the original notification provider that a legal action has been filed seeking a court order to restrain the alleged infringer from engaging in the infringing activity.

 

The Process You Follow:

We ask that you follow the DMCA notification process if you believe you have a claim of copyright infringement.  We are permitted to share these notifications with others under our Privacy Policy.

If you believe that any content on our Site violates your copyrights, you must provide us written notification by fax, overnight mail or regular U.S. mail to our DMCA Agent, at:

Your notice must contain the following information:

  1. Provide us with information sufficient to contact you, such as an address, telephone number and email address;
  2. Identification and a description of the content that you claim is infringed and a statement that you own that content, providing us sufficiently detailed information to locate the content;
  3. A statement that the content be removed or disabled;
  4. A statement that you have a good faith belief that use of the content in the manner complained of is not authorized by the copyright owner, its agent or the law;
  5. Include the following statement:  “I have a good faith belief that the use of the content described above and contained on the Site is not authorized by the copyright owner, its agent or by protection of law”;
  6. A statement, under penalty of perjury, that the information in the notification is accurate and that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed;
  7. Your physical or electronic signature (i.e., “/s/ [print name]”); and
  8. The DMCA provides that you may be liable for damages (including costs and attorneys’ fees) if you falsely claim that materials infringe your copyrights.

 

Counter Notifications.  

If we take down your content as a result of receiving a DMCA notification, you may respond by sending us a DMCA counter notification.  The counter notification must include the following:
 

  1. Your name, address, telephone number and email address at which you may be contacted;
  2. A list of the content that was removed by Putzmeister, the location of the content before it was removed, and sufficient detail so we may identify and locate that content;
  3. A statement that you consent to the jurisdiction of U.S. Federal District Court for the judicial district in which you reside (or New York, New York if your address is outside of the United States);
  4. A statement that you will accept service of process from the person (or their agent) who provided notification to us of the alleged infringement;
  5. The following statement:  “I swear, under penalty of perjury, that I have a good faith belief that the material identified above was removed or disabled as a result of a mistake or misidentification of the material to be removed or disabled”; and
  6. Your physical or electronic signature (i.e., “/s/ [print name]”).
