2.   Principles of data processing and storage period 

2.1.   Legal basis for the processing of personal data 

Insofar as we obtain your consent for the processing of personal data, point (a) of Article 6 (1) GDPR is the legal basis for the processing of personal data. Any consent can be withdrawn by you with effect for the future.

When processing personal data that is required for the performance of a contract with you or your Company, point (b) of Article 6 (1) GDPR is the corresponding legal basis. This also applies to processing operations that already become relevant pre-contractually.

Insofar as processing of your personal data is necessary for the fulfillment of one of our legal obligations, point (c) of Article 6 (1) GDPR serves as the legal basis.

If the processing is necessary to protect a legitimate interest of our company or a third party and your interests, fundamental rights and freedoms do not override our legitimate interest, point (f) of Article 6 (1) GDPR serves as the legal basis for the processing.

2.2.   Data storage and erasure 

In principal personal data is only stored by us as long as the specific purpose as required by the purpose for which personal data is stored. If the purpose of storage ceases to apply, your data will be erased or the processing of data will be restricted.

In addition, it may be that European regulations, applicable national laws or other regulations require a longer storage of the data processed by us. If these storage periods expire, we will erase your data or restrict the processing thereof.

2.3.   Recipients of data

We will generally only disclose your personal data to service providers, business partners and other third parties in accordance with the applicable data protection laws and inform you of the disclosure in accordance with legal requirements.

We may disclose personal data to service providers and require them to perform services on our behalf (processing according to Article 28 GDPR). In this context, we comply with the strict applicable national and European data protection regulations. The service providers are subject to our instructions and are subject to strict contractual restrictions regarding the processing of personal data. Our Putzmeister Website and thus also your data are hosted at Microsoft Ireland Operations Limited, One Microsoft Place, South County Business Park, Leopardstown, Dublin 18, D18 P521, Ireland ("Microsoft"). Microsoft may only access the data within the scope of our instructions (processing according to Article28 GDPR)

Microsoft implements strict technical measures to protect your personal data. Microsoft will not disclose your personal data to third parties unless the disclosure is necessary to perform the agreed services or Microsoft is required to do so in order to comply with the law or a valid and binding order of a governmental or regulatory authority. The data transferred for this purpose will be limited to the minimum required

Microsoft has also stated that Microsoft plans to introduce the "European Union Data Boundary," where Microsoft undertakes not to transfer data from the EU to third countries. Your data is already hosted on servers in the European Union ("EU") or the European Economic Area ("EEA").

Despite these measures, it cannot be ruled out with absolute certainty that Microsoft may also store or transfer personal data to countries outside the EEA. However, Microsoft will undertake the necessary steps to ensure that an adequate level of data protection is maintained. For example, if Microsoft transfers your personal data to the United States, additional measures, such as entering into EU-compliant data transfer agreements with the data importer, will be taken if necessary. In addition, as a precautionary measure, we have entered into standard contractual clauses with Microsoft to also safeguard data transfers to third countries in the event that a data transfer to a third country does occur despite the measures listed above. 2.3.3.   Forwarding of your data to affiliated companies of Putzmeister 

Your data will be passed on partly to other Putzmeister Companies for the purpose of processing your enquiry and providing the services provided via the Putzmeister Website

The legal basis for this data processing is point (b) and point (f) of Article 6 (1) GDPR or the data processing agreement with the processor. To the extent that there is no contractual performance for you and no data processing agreement concluded, we have a legitimate interest in transferring the data for internal administrative purposes to the relevant Putzmeister Company and the business units responsible there. This enables the Putzmeister Group to offer you the services provided via the Putzmeister Website as efficiently as possible

3.   Your rights 

Insofar as we process personal data from you, you are a "data subject" within the meaning of the GDPR. As a data subject, you have the following rights against us:

3.1.   Right of access regarding the processing 

You can request information from us at any time within the scope of the statutory provisions whether personal data is being processed by us. If this is the case, you have the right to request information about the scope of data processing (cf. Article 15 GDPR). Please note that the right to access regarding the processing of data may be restricted in certain legal circumstances

3.2.   Right to rectification 

You have a right to obtain your data rectified and/or completed by us if the personal data processed concerning you is inaccurate or incomplete (cf. Article 16 GDPR).

3.3.   Right to restriction of processing 

When the prerequisites are met, you have the right to request the restriction of the processing of your personal data (cf. Article 18 GDPR).

3.4.   Right to erasure 

When the prerequisites are met, you can request the erasure of the personal data concerning you without undue delay. The right to erasure does not exist, for example, insofar as the processing is necessary (cf. Article 17 GDPR).

3.5.   Right to information 

If you have asserted the right to rectification, erasure or restriction of processing, we are obliged to inform all recipients to whom the personal data concerning you have been disclosed of this rectification or erasure of the data or restriction of processing, unless this turns out to be impossible or requires a disproportionate effort. The Controller informs about these recipients upon your request (cf. Article 19 GDPR).

3.6.   Right to data portability 

You have the right to receive the personal data concerning you that you have provided to us in a structured, commonly used and machine-readable format. In addition, you have the right to transfer this data to another company without hindrance from us, provided that the prerequisites are met (cf. Article 20 GDPR).

3.7.   Right of objection 

You have the right to object at any time, based on reasons arising from your particular situation, to the processing of personal data relating to you which is carried out on the basis of point (f) of Article 6 (1) GDPR (Article 21 (1) GDPR). The consequence of the objection is that Putzmeister or the respective Putzmeister Company responsible for data processing no longer processes the personal data relating to you, unless Putzmeister or the respective Putzmeister Company responsible for data processing can demonstrate compelling legitimate reasons for the processing which override your interests, rights and freedoms, or the processing serves to assert, exercise or defend legal claims.

We ask you to direct your objection to the Putzmeister Company responsible for the data processing. We will inform you separately in the appropriate section in this Privacy Statement when the data is processed by Putzmeister Holding GmbH but by another Putzmeister Company. 3.8.   Right to withdraw given consent under data protection law

If you have given your consent, you can withdraw your consent at any time. The withdrawal of consent does not affect the lawfulness of the processing carried out on the basis of the consent until the withdrawal

3.9.   Right to lodge a complaint with a data protection supervisory authority 

Without affecting any other administrative or judicial appeals, you have the right to lodge a complaint with a data protection supervisory authority, in particular in the EU Member State of your residence, place of work or place of the alleged infringement, if you consider that the processing of personal data relating to you infringes applicable data protection laws.

4.   Security standards 

We have implemented appropriate physical, technical and administrative security standards to protect personal data from loss, misuse, alteration or destruction. All service providers and affiliates are contractually obligated to maintain the confidentiality of personal data. In addition, they may not use the data for any purpose that have not been authorized to us.

Because the security of your data is important, your entire visit is handled over a secure TLS connection. If personal data is collected, the data transfer is also TLS-encrypted. The TLS encryption process protects your data from unauthorized access on its way through the internet.

We may update this Privacy Statement from time to time to ensure that it remains compliant with current legal requirements or to reflect changes to our services available through the Putzmeister Website (e.g., introduction of new services). B.   DATA PROCESSING ON THE PUTZMEISTER WEBSITE 

1.   Protocol data / log files 

Each time you access the Putzmeister Website, our system automatically collects data and information from your end device. In particular, the following data is collected:

  • the IP address of the requesting end device
  • the date and time of access
  • the website from which the requested file was accessed (referrer URL)
  • a description of the browser and the version of the browser used
  • if applicable, the installed operating system and the resolution set
  • the name of the file and the URL of the requested file
  • a description of the access provider you use
  • the duration of your visit
  • the amount of data transferred
  • the access status (i.e. whether the file was transferred or possibly not found, etc.)

The aforementioned data are stored in the log files of our system. In general, this data is not stored together with other personal data. To the extent access statistics are created, your IP address is anonymized by the hoster by truncating the last bytes of the IP address. Your IP address can therefore no longer be attributed to you in the access statistics

The legal basis for the temporary storage of the data and log files is point (f) of Article 6 (1) GDPR. We have a legitimate interest in collecting and temporarily storing the aforementioned data, because the temporary storage of the IP address by the system is necessary to deliver the website to your end device. The temporary storage of the data also takes place in order to enable the delivery of the website. In addition, this data is used to optimize our website and to ensure the functionality of the website and the security of our information technology systems. The log files are not evaluated for marketing purposes.

The data stored in log files is usually erased after 30 days. The data is stored to ensure system security, e.g. to be able to clarify incidents of misuse, security or malfunctions. Data from log files whose further storage is necessary for evidence are generally excluded from erasure until the final clarification of the respective incident. When you use our Putzmeister Website, various types of cookies are used and stored on your end device. Cookies are small text files that are stored on your end devices when you visit our Putzmeister Website. Various information is provided to us by cookies

If the storage or access is absolutely necessary so that we can provide a service that you have expressly requested, Section 25 (2) No. 2 TTDSG is the relevant legal basis.

Plugins from www.youtube.com are integrated on our website. We use embedded YouTube videos in extended data protection mode. YouTube describes its mode of operation as follows: "With the extended data protection mode, you can embed YouTube videos without cookies being set to analyze user behavior. This means no user activity data is collected to personalize video playback. Instead, video recommendations are based on the actual video. Videos played in enhanced privacy mode do not affect which videos are recommended to a user on YouTube.

The data processing within the scope of the application process serves to decide on the conclusion of an employment between you and the respective Putzmeister Company at which the vacant position is to be filled. The primary legal basis for this is point (b) of Article 6 (1) GDPR or section 26 (1) Federal Data Protection Act (“BDSG”) or comparable national regulations. Personal data will only be processed for purposes related to your interest in current or future employment with the respective Putzmeister Company and the processing of your application.

Within the Putzmeister Group, the centralised human resources department at Putzmeister Holding is responsible for receiving, coordinating, managing and forwarding applications. If Putzmeister Holding does not fill the vacant position, your application will be forwarded to the company where the respective vacancy is open or to which your unsolicited application is assigned. Insofar as Putzmeister Holding is not itself responsible for the further processing of the application as a potential employing company, Putzmeister Holding will act on the basis of an agreement on joint responsibility. Putzmeister Holding is also available to you as a central point of contact for data protection issues in connection with the application process, against whom you can assert your data protection rights and which coordinates the processing of your rights as a data subject. Your application will only be processed and acknowledged by the contact persons of the respective Putzmeister company who are relevant for the application process. If the respective Putzmeister company is unable to offer you employment, the data transmitted by you will generally be stored for up to four months after rejection for the purpose of being able to answer your questions in connection with your application and rejection, unless other statutory retention obligations are considered.

You have the option of using the MY PM-Service product and color configurator on our Putzmeister Website without being registered with MY Putzmeister or logged into your MY Putzmeister user account. C.   DATA PROCESSING OPERATIONS WHEN USING MY PM SERVICES 

1.   Controller

Putzmeister Holding GmbH is the responsible party for the "MY Putzmeister" platform. within the meaning of the GDPR. Digital services for products of the Putzmeister Group ("MY PM Services") are accessible via MY Putzmeister. For the individual MY PM Services, other Putzmeister Companies may be the Controller within the meaning of the GDPR. To the extent that this is the case, we indicate this

2.   Registration for MY Putzmeister 

In order to use MY Putzmeister and the services that can be accessed via MY Putzmeister, it is necessary to register and create a user account with MY Putzmeister

In this context, MY Putzmeister offers both companies that offer the products for purchase or rent to other companies ("Dealers") and the respective companies that purchase or rent the products ("End Customers") (Dealers and End Customers hereinafter jointly referred to as "Company") an opportunity to access supplementary professional information on the products via the MY PM Services, as well as to use additional services via MY Putzmeister in connection with the Putzmeister Group products

2.1.   Registration process for MY Putzmeister

Employees of companies can register for MY Putzmeister. When registering for MY Putzmeister, there are certain mandatory details that you must provide as well as voluntary details that are marked separately

We use, store and process this data, because this is necessary to conclude, define the terms or change the contract of use between you and us as well as for the use of the MY PM Services provided via MY Putzmeister.

If you have registered successfully, you can log in to your user account after activation. We use, store and process the data you use for registration, such as your e-mail address and the password you specify, so that you can log in to MY Putzmeister and access the MY PM Services available for retrieval there.

The legal basis for the aforementioned data processing within the scope of registration for MY Putzmeister is point (b) and (f) of Article 6 (1) GDPR. We erase your data as far as they are no longer necessary for the stated purpose and no contractual or legal retention periods exist

2.2.   Activation process 

In order to examine whether you are authorized to use MY Putzmeister as an employee on behalf of the Company, Putzmeister may transmit the information entered as part of your registration, to the Company or the Dealer of your employer before activating your profile. In this case, the transmission of your data entered during the registration process to the Company or the Dealer, is performed to examine whether you belong to the Company and whether you are authorized to use MY Putzmeister and the MY PM Services

The legal basis for the aforementioned data processing as part of the activation process for individual MY PM Services is point (b) and (f) of Article 6 (1) GDPR. We erase your data insofar as they are no longer required for the aforementioned purpose and no contractual or legal retention periods exist

2.3.   Accessibility of data for other users 

Other users of MY Putzmeister may see your contact information while using the MY PM Service MY Fleet within the scope of the intended use of MY Putzmeister, provided that this information is stored in MY Fleet

3.   MY PM-Service: Product and color configurator

You have the option to request the realization of the configuration you have made from us. If you are logged in to MY Putzmeister, you can send the configuration without providing any further data. The configuration you send will be automatically assigned to the data you have stored in your user account at MY Putzmeister

If you do not have a MY Putzmeister user account, you can also request the configuration you have made. To do this, you can either fill out an inquiry form or send the code assigned to the respective configuration to a Dealer or sales contact of the Putzmeister Group (e.g. via e-mail)

If you request the configuration from us via the request form or via e-mail, the data entered in the fields or provided via e-mail will be transmitted to us and stored. This includes in particular your surname and first name as well as your e-mail address and all other data entered in the fields or disclosed by you in the e-mail

The legal basis for the processing of the data transmitted in the context of the configuration request is point (b) or (f) of Article 6 (1) GDPR. The processing of personal data serves us solely to process your configuration request and to contact you. This is in our interest. This may already be a contract initiation.

We transmit your personal data entered in the context of the configuration request to the Putzmeister Company which is responsible within the Putzmeister Group for the realization of corresponding configurations. The legal basis for the processing of the data transmitted in the context of the configuration request is point (b) or (f) of Article 6 (1) GDPR.

The data is erased as soon as it is no longer required to achieve the purpose for which it was collected and insofar the erasure is also not in conflict with any mandatory archiving obligations. Data processing for the purpose of handling the configuration request is stopped in any case when it can be inferred from the circumstances that the matter concerned has been conclusively clarified

4.   MY PM Service: Warranty Tool 

Controller according to the GDPR: The Warranty Tool is a service provided by Putzmeister

Putzmeister offers you the possibility via the Warranty Tool to digitally settle warranty claims on behalf of the Company for products, that are subject to warranty or special complaint provisions or for which the Putzmeister Companies have given a guarantee ("Warranty Request").

As part of the Warranty Request, various data about the product, the defect and any repairs already carried out on the defect are requested. If you decide to report a warranty case via the warranty tool, the data entered in the fields will be transmitted to Putzmeister and stored. This includes, in particular, your e-mail address stored for the registration to MY Putzmeister and all other data entered in the fields.

After you have sent the completed Warranty Request, Putzmeister will forward it with all the data you have provided to the Putzmeister Company that introduced the defective product on the market and is in charge of handling the warranty case within the Putzmeister Group. The data will be transmitted exclusively for the purpose of remedy of the warranty case reported by you

5.   MY PM Service: MY Fleet 

Controller according to the GDPR: MY Fleet is a service provided by Putzmeister.

Through MY Fleet, Putzmeister offers you the possibility to centrally manage the Company's entire fleet of machines on behalf of the Company, to retrieve individual information about the machines, and to obtain an overview of upcoming maintenance work ("Upcoming Services") on the machines in the fleet.

At MY Fleet, you have the option of storing your contact data as a contact person for the Company, including your name, e-mail address and telephone number. Furthermore, as an employee of the End Customer of the machine, you have the option of entering yourself as the contact person for services to be provided for the machines in the fleet. In addition, you can select within the input fields for the contact data whether you would like to receive notifications about Upcoming services to the e-mail address you have stored. In these e-mail notifications, we inform you when a service status of a machine has changed (e.g. information about upcoming or overdue maintenance work on the machine). You have the option to remove the contact data you have stored at any time

Putzmeister processes the data provided by you exclusively in order to provide you with the services within the scope of MY Fleet and to send you the aforementioned e-mail notifications on the service status. The data provided by End Customers is accessible to the Dealer registered with the machine, provided that the Dealer is also authorized to access MY Fleet. This ensures that the Dealer has access to the End Customer's current contact data and can assist the End Customer in the event of problems with services on the machine

If Dealers are authorized to access MY Fleet, the Dealer's employees can store their contact data as a contact for End Customers. The data provided by the Dealer's employees is accessible to End Customer registered with the machine.

6.   MY PM-Service: Quick Service List 

Controller according to the GDPR: The Quick Service List is a service provided by Putzmeister.
Putzmeister offers you the possibility via the Quick Service List to reserve the machines shown in the Quick Service List without obligation by submitting a request to the sales department of the Putzmeister Group on behalf of the Company

The data provided by you in the reservation request (such as name, company, contact data, etc.) will be transmitted to and stored by Putzmeister. Putzmeister will forward your reservation request and the data contained therein to the responsible department within the Putzmeister Group, so that your reservation request can be processed by the respective competent department

The legal basis for the processing of the data is point (b) or (f) of Article 6 (1) GDPR. The processing of personal data provided in the reservation request and the transmission of the personal data to other companies of the Putzmeister Group is performed - in addition to the above-mentioned purposes - solely to process your reservation request. You will receive notifications about maintenance intervals and critical machine conditions directly within Machine Cockpit. In addition, we use the e-mail address you provided during registration to send you e-mail notifications about upcoming maintenance intervals and critical machine conditions

The MY PM Service Machine Cockpit and thus also your data are hosted by Amazon Web Services EMEA SARL, 38 Avenue John F. Kennedy, L-1855 Luxembourg ("Amazon EMEA") and Amazon Web Services Inc., 410 Terry Avenue North, Seattle WA 98109, United States (hereinafter "Amazon USA"; collectively both: "Amazon")

Amazon EMEA processes and stores your data as a user of the MY PM-Service Machine Cockpit, regardless of the region in which you register. The machine data generated in the course of using the MY PM-Service Machine Cockpit, which is not personal data, is processed and stored by Amazon USA for Putzmeister machines that are sold in the United States of America. Machine data of all other machines are processed and stored by Amazon EMEA.

Amazon may only access the data within the scope of our instructions (Processing according to Article 28 GDPR). Amazon also undertakes strict technical measures to protect your personal data. Amazon does not disclose your personal data to third parties, unless the disclosure is necessary to provide the agreed services or Amazon must do so to comply with the law or a valid and binding instruction of a governmental or regulatory authority. The data transferred for this purpose will be limited to the minimum.

Amazon may also store the information in countries outside the European Economic Area. However, Amazon will take the necessary steps to ensure that an adequate level of data protection is maintained. For example, if Amazon transfers your information to the United States, additional measures, such as entering into EU-compliant data transfer agreements with the data importer, will be taken. 8.   MY PM Service: Web Store 

Controller according to the GDPR: The web store is a service provided by Putzmeister.

8.1.   Purchase and inquiry of products via the web store

You have the possibility to order products on the Putzmeister Website via your MY Putzmeister account. A guest order is not possible. If you do not have a MY Putzmeister account, you can only request the products

If you order via your MY Putzmeister account, a major part of the data you have stored in your account will be automatically transferred for the execution of the order. It is not necessary to enter the data again. Your personal data necessary for the execution of the order will be transmitted to the Putzmeister Company that sells the product and thus realizes the order.

If you would like to send an inquiry for a product, the data listed below must be provided:

  • E-mail address
  • Company name
  • First and last name
  • Address of the company/customer
  • Country

Other data that you can specify, such as the request text and the salutation are optional.
Putzmeister uses, stores and processes this data, because this is necessary to conclude, to define the terms of or to change the contractual relationship between you and Putzmeister and for the receipt and billing of the related services as well as for the initiation of contracts for requested products.

8.2.   Payment by credit card

If you choose to pay by credit card, the payment will be processed by the payment service provider Adyen N.V. German Branch, Friedrichstraße 63, 10117 Berlin ("Adyen")

If you pay by credit card, Adyen collects the following data:

  • Name of the credit card holder
  • Credit card number
  • Credit card validity period
  • Security code

Putzmeister does not collect and store the payment data itself. The payment data are collected directly by Adyen. In addition to the payment data provided, Adyen only has knowledge of the order number and the invoice amount without being able to assign this information to other information.

Putzmeister complies with the highest security and data protection requirements when working with Adyen. Adyen complies with the requirements of the "Payment Card Industry (PCI) Data Security Standards" and has been certified according to level 1 of the PCI standard (for more information, please click here: https://www.adyen.com/legal). Adyen is also audited by the Payment Card Industry Security Standards Council for compliance with the PCI standard.

D.   PUTZMEISTER GROUP ON SOCIAL MEDIA 

1.   Data processing by social media platforms in general 

We operate publicly accessible company profiles on social media platforms in order to inform about our news, events and to provide insights into the company of Putzmeister and other companies belonging to the Putzmeister Group. Furthermore, contact with you as a user/visitor is made possible by the social media platforms. On which platforms we operate a company profile can be found below in section 6.

Social media platforms such as Facebook, Twitter, etc. can generally analyze your user behavior extensively when you visit their website or a website with integrated social media content (e.g. like buttons or advertising banners). By visiting our social media presences, numerous processing operations relevant to data protection occur. The respective social media platforms may provide us with anonymized statistics and insights about, among other things, interactions with our posts. From the information, we can see whether our website was accessed by users/visitors from the respective platform via our company profile as well as, among other things, the age/gender groups (the latter only for logged-in users). We have no influence on the data transmitted to us and cannot stop this procedure on the part of the social media platforms. We use the data transmitted to us in order to optimize our contributions and our presence and to be able to design them according to the interests of our website visitors.

The social media platforms store cookies on your end device or record your IP address. This enables the social media platforms to evaluate the data of the visit from the social media platform and our company profile for statistical and market research purposes and can help to optimize future advertising measures on the part of the social media platforms. Thus, it may be that the social media platforms themselves use the collected data about the user behavior of users/visitors for the placement of personalized advertising, which can be displayed on all devices on which you are/were logged in.

If you are logged in into a social media platform when you visit our company profile, the data of the visit to our company profile may be assigned to your account and linked to the data of this account. 2.   Legal basis 

On the part of Putzmeister, there is a legitimate interest for the operation of the company profile and the processing of your data in order to be able to design and implement the contemporary possibilities of information and communication accordingly. The legal basis in this case is point (f) of Article 6 (1) GDPR.

If you contact us via the message function or via the e-mail address stored in our company profile, we will store your user profile ID or e-mail address as well as other data you have provided. The legal basis for the processing is point (b) of Article 6 (1) GDPR, insofar as the contact is a contract initiation or related to contractual topics. We also have a legitimate interest in processing your data in order to respond to your inquiry, point (f) of Article 6 (1) GDPR.

The analysis procedures used by the social media platforms may be based on different legal grounds, which are to be specified by the providers of the social media platforms (e.g. consent within the meaning of point (a) of Article 6 (1) GDPR, where consent can be withdrawn at any time).

3.   Controller 

According to a decision of the European Court of Justice, fan page operators (i.e. including us) together with the social media platform are joint controllers within the meaning of the GDPR.
Due to the collection and storage of data (and user data) by the social media platforms, you can also assert your rights against the respective platform. You can find your rights against us under section A.3.
